RESUMO O objetivo deste artigo é analisar a primeira fase da consulta pública on-line da regulamentação do Marco Civil da Internet (MCI), conduzido pela Secretaria de Assuntos Legislativos (SAL). O site da consulta recebeu mais de 60 mil visitas, contabilizando em torno de 1.200 comentários. Os objetivos específicos dizem respeito a: i) elencar as principais características do desenho institucional (as regras e as características da consulta) e do desenho da ferramenta (o formato da plataforma da consulta); ii) realizar uma análise de conteúdo dos comentários dos participantes a partir de uma amostra de 235 mensagens correspondendo às dez pautas mais comentadas pelos usuários. No que concerne ao desenho institucional, percebeu-se que houve uma aproximação com a sociedade civil e outros órgãos governamentais. Com relação à análise de conteúdo das mensagens, houve concentração de participação de poucos usuários, porém houve altos valores de justificação, uso de fontes, reciprocidade e respeito. Como os resultados, no geral, se aproximam muito daqueles vistos em consultas anteriores do MCI, refletimos sobre os limites desse formato.

ABSTRACT The objective of this article is to analyze the first phase of the public consultation of the regulation of the Brazilian Civil Internet Framework (MCI), conducted by the Secretary for Legislative Affairs (SAL). The website hosting the debate received more than 60,000 hits, accounting for around 1,200 comments. The objectives of this article are i) to highlight the main characteristics of the online platform design and the institutional design; and ii) to analyze the comments of the public consultation of MCI’s first phase. We analyzed a sample of 235 messages corresponding to the ten most frequently commented messages. Regarding the institutional design, it was noticed that there was an approximation with civil society and other government agencies. Regarding the content analysis of the messages, the participation was concentrated on a few users, who intensively used the possibility of expressing agreement or disagreement in the messages, as well as justified to a large extent their arguments through external sources; there was also reciprocity and respect for almost all users. As the results generally approximate those seen in previous MCI researches, we reflect on the limits of this consultation format.
